REL: More power for the Intelligence Service in Albania, but also more question

The State Intelligence Service (SHISH) in Albania is expected to receive broader powers - for the first time since the adoption of its basic law in 1998.

In addition to traditional tasks in the field of counterintelligence and national security, the institution will also have a mandate to collect information on threats to economic security, cyberattacks, hybrid threats, and critical infrastructure.

The government argues that the changes are necessary to respond to new security challenges, which did not exist when the current law was drafted.

The opposition and security experts do not oppose the need to modernize the law, but warn that the expansion of powers has not been accompanied by sufficient guarantees for democratic control of the institution.

What changes with the new law?

The law approved by the Albanian Parliament on July 2 significantly expands the scope of SHISH's operations.

In addition to collecting information on espionage, terrorism, and protecting constitutional order, the institution is also tasked with identifying threats to economic security, cyberattacks, hybrid threats, and critical infrastructure.

At the same time, powers are expanded to monitor the activity of foreign intelligence services, extremism, and issues related to internal and regional stability.

According to the Government, these changes reflect how threats to national security have evolved.

The accompanying report of the law states that economic security is now part of a state's strategic security, while cyberattacks and hybrid threats constitute among the most serious challenges for public institutions, the economy, and critical infrastructure.

Debate on control and transparency

The need to update the law is not opposed even by the opposition.

But, according to her, the expansion of SHISH's mandate has not been accompanied by the strengthening of oversight mechanisms.

Democratic Party MP Klevis Balliu tells Radio Free Europe that the law gives the institution more power and access to information, without clearly defining the limits of its activity and the way in which the exercise of these powers will be controlled.

"Giving it more power and authority without seeking increased control and without specifying the boundaries of this institution, I think we are opening the door to a dangerous situation, which we will have to face tomorrow," says Balliu.

A similar assessment is given by security expert Gert Metani.

Sipas tij, dispozita që i jep SHISH-it kompetencë të mbledhë informacion edhe për “stabilitetin e brendshëm dhe rajonal” mund të krijojë hapësirë për interpretime të gjera, nëse nuk shoqërohet me kufizime të qarta ligjore dhe mbikëqyrje efektive parlamentare e gjyqësore.

“Duke njohur klimën politike shqiptare, ekziston rreziku që dispozita të tilla të keqpërdoren në dëm të lirive dhe të drejtave të qytetarëve”, thotë Metani për Radion Evropa e Lirë.

Por, debati nuk kufizohet vetëm te zgjerimi i kompetencave të SHISH-it.

Ligji i ri e përjashton SHISH-in edhe nga detyrimet që rrjedhin nga Ligji për të Drejtën e Informimit.

Kjo do të thotë se SHISH-i nuk do t’u nënshtrohet të njëjtave rregulla transparence si institucionet e tjera publike, duke mos pasur detyrim t’u përgjigjet kërkesave për informacion sipas këtij ligji.

Qeveria argumenton se një përjashtim i tillë, është praktikë edhe në vende të tjera, duke përmendur shërbimet inteligjente britanike, gjermane dhe amerikane.

Sipas saj, edhe informacionet që mund të duken administrative apo financiare, mund të kenë vlerë operative dhe, nëse bëhen publike, mund të cenojnë sigurinë kombëtare.

Opozita nuk kundërshton nevojën për mbrojtjen e informacionit të klasifikuar, por argumenton se përjashtimi i plotë nga Ligji për të Drejtën e Informimit rrezikon të kufizojë llogaridhënien publike.

Deputetja e Partisë Demokratike, Jorida Tabaku, thotë se një zgjidhje më e balancuar do të ishte përjashtimi vetëm i informacioneve të ndjeshme, duke ruajtur një nivel minimal transparence për çështjet administrative dhe financiare.

Pasuria dhe databazat, dy pika tjera përplasjesh
Një tjetër ndryshim që ka nxitur debat lidhet me deklarimin e pasurisë së punonjësve të SHISH-it.

Ligji parashikon që ata të mos i deklarojnë më të ardhurat dhe pasurinë pranë Inspektoratit të Lartë të Deklarimit dhe Kontrollit të Pasurive.

Kontrolli do të kryhet nga një strukturë e posaçme brenda vetë SHISH-it.

Qeveria argumenton se ky ndryshim synon të mbrojë identitetin dhe të dhënat e punonjësve të inteligjencës, pasi edhe niveli i pagave të tyre konsiderohet informacion i klasifikuar.

Edhe këtu opozita kërkon një zgjidhje tjetër.

Sipas Tabakut, deklarimi i pasurisë nuk duhet të hiqet, por të zhvillohet në një regjim të klasifikuar, në mënyrë që të ruhen njëkohësisht edhe sekreti shtetëror, edhe kontrolli mbi pasuritë e zyrtarëve.

Ajo paralajmëron se heqja e këtij mekanizmi krijon një precedent që mund të shtrihet edhe në institucione të tjera.

Eksperti i sigurisë, Gert Metani, ndan të njëjtin shqetësim.

Sipas tij, natyra sekrete e punës së SHISH-it nuk duhet të nënkuptojë mungesë kontrolli.

"Internal control must be accompanied by independent and effective oversight, keeping in mind that, despite anonymity and secret work, intelligence structures are paid with public funds and thus accountability - at no point - should be lacking," he says.

The new law also grants SHISH the right to access state databases, provided that it is regulated through inter-institutional agreements and limited to the institution's legal duties.

The government says this does not mean unlimited access.

According to her, inter-institutional agreements will determine what data can be used, by whom and for what purpose, as well as how to control it.

But the opposition and experts are demanding stronger guarantees.

They recall that Albania has experienced several cases of leaks of state databases and cyberattacks, where personal data of citizens, as well as information related to state institutions, has been exposed.

Metani considers access to databases an indispensable tool for modern intelligence services, but says it must be limited, proportionate and fully traceable.

He warns that any misuse of personal data would further undermine citizens' trust in institutions, recalling previous cases of publication of state databases.

Are the changes related to the political climate?

Expert Gert Metani also expresses doubts about the timing of the changes being approved.

According to him, they should be seen in the context of recent political developments in the country, including the protests that have been demanding the resignation of Prime Minister Edi Rama for weeks.

He argues that, although the draft law was drafted before the protests began, certain wording may create room for broad interpretations in relation to monitoring civic discontent.

In this context, Metani also mentions previous Government decisions, such as restrictions on the TikTok platform or debates on monitoring public information, warning that the main challenge remains maintaining the balance between increasing SHISH's capacities and protecting fundamental rights and freedoms.

"The recent changes to the Law on the State Intelligence Service reflect a restrictive measure on the expression of civic discontent through constitutional protests," the expert says.

The law has received the approval of the Albanian Parliament, but has not yet been decreed by the president of the state.
