Before the trial/ Why Veliaj is plunging the Municipality into chaos

Through a letter signed by the detention facilities and distributed to the media on Saturday, Tirana Mayor Erjon Veliaj revoked the order to delegate the mayor's powers to Deputy Mayor Anuela Ristani.

Ristani served as acting mayor after Veliaj was arrested on February 10, 2025 at the request of the Special Prosecution Office, SPAK, accused together with his wife Ajola Xoxa of building a complex corruption and money laundering scheme to illegally benefit from the capital's municipality funds and bribe businessmen using a network of companies and non-profit organizations.

In his letter, Veliaj claims that Ristani has consistently refused his orders, there has been a lack of institutional coordination, and the normal chain of responsibility and direction of the institution has been violated.

In this context, he argues that her dismissal aims to guarantee "the legality, continuity, stability and normal functioning of the Municipality of Tirana, the uninterrupted provision of public services and the protection of the interests of citizens..."

However, Veliaj, in his order, does not specify which of the other deputy mayors of the municipality will exercise his powers in the future, creating uncertainty about the direction and daily organizational functioning of the institution.

This is an action that, according to the opposition, lawyers, and local government experts, is intentional to create a legal impasse in the management of the largest municipality in the country.

Members of the Democratic Party's municipal council asked the Mayor of the Municipal Council, Megi Fino, on Monday to call an emergency meeting of the council to discuss the situation.

"This news has created complete legal and public uncertainty about the current direction of the Municipality of Tirana, and requires immediate and official clarification before the Municipal Council and the citizens of Tirana," the request states.

Opposition councilors are seeking clarification on who exercises the function of mayor and whether there is an institutional authority to negotiate, decide and sign on behalf of this municipality, questioning the existence of an institutional leadership chain that guarantees the normal institutional functioning of the institution.

“Veliajt i duhet për presion përpara seancës së Gjykatës së Lartë, ndërsa Edi Ramës i duhet që Veliaj të tërheqë njerëzit e vet nga protesta dhe rrjeti i mediave të huaja”, tha Alimehmeti për BIRN.

“Nëse Veliaj nuk delegon një tjetër nënkryetar e paralizon bashkinë totalisht në çdo aspekt dhe ky bllokim bëhet edhe më i rëndë duke marrë parasysh se ndodh pikërisht ndërkohë që hyn shtatori dhe rifillon viti shkollor”, shtoi ai.

Një ngërç juridik që kërkon zgjidhje

Edhe pse ndodhet në burg me disa akuza për korrupsion e pastrim parash, Erjon Veliaj ndoqi një betejë ligjore për të ruajtur mandatin e kryebashkiakut, pasi Këshilli Bashkiak me shumicë socialiste dhe me kërkesë të Kryeministrit Edi Rama votoi shkarkimin e tij dhe Këshilli i Ministrave e miratoi këtë shkarkim, me justifikimin se qytetit i duhej një kryetar në zyrë.

Ai ankimoi në Gjykatë Kushtetuese shkarkimin dhe dekretin e presidentit për shpalljen e zgjedhjeve të pjesshme vendore për zëvendësimin e tij.

GJK doli në konkluzionin se shkarkimi i tij nuk ishte justifikuar me ‘shkeljen e rëndë të Kushtetutës dhe të ligjeve’ dhe se ‘mbrojtja e interesit publik për të garantuar të drejtën e zgjedhësve për t’u qeverisur nga një organ i zgjedhur drejtpërdrejt, nuk mund të justifikojë cenimin e garancive kushtetuese’.

Ky vendim konsiderohet po ashtu si ‘pengesë’ për një ndërhyrje të re në funksion të zgjidhjes së ngërçit të krijuar nga ana e qeverisë.

“Nuk është çështje e Këshillit të Ministrave për sa kohë sipas GJK bashkia e Tiranës ka kryetar në krye të detyrës”, tha zyra e shtypit pranë kryeministrit për BIRN.

Për ekspertë të pushtetit vendor dhe juristë, Erjon Veliaj e ka vendosur bashkinë para një situate të paprecedentë juridike dhe po e përdor këtë moment për të ushtruar ‘presion’ ndaj vendimit të pritshëm të Gjykatës së Lartë më 15 shtator, kur dhe do të rishqyrtohet masa e arrestit ndaj tij.

“Duke mos deleguar një nënkryetar të ri si kryetar të bashkisë Veliaj po përdor të vetmin instrument që ai ka tani për të ushqyer argumentet para Gjykatës së Lartë”, tha për BIRN Agron Haxhimali, kryetar i Institutit të Bashkive.

“E fut në krizë drejtimi bashkinë, por ndërkohë ai vet nuk mund ta kryejë detyrën e kryetarit nga bashkia, pasi kjo lidhet me anën protokollare dhe praktike dhe ligjërisht ushtrimi I detyrës kërkon praninë fizike dhe komunikim me vartësit…”, shton Haxhimali.

He argues that logically Veliaj should have appointed a new vice-president to carry out the duties of the president in the same legal act dismissing Ristan, despite the fact that the law on local self-government does not expressly oblige him to do so.

For lawyer Gentjan Serjani, the order signed by Veliaj does not make it "automatically" legal as an act and is attackable from a legal point of view.

"For me, the argument for repealing the previous order is not according to the criteria set out in Article 116 of the Code of Administrative Procedures," Serjani told BIRN.

According to him, the legal basis used is Article 8, point 2 and Article 64 of Law No. 139/2015 “On Local Self-Government”, as well as Article 113 of Law No. 44/2015 “Code of Administrative Procedures”, provisions that can be questioned as to whether they are 'sufficient for the repeal of a lawful administrative act'.

For Serjani, running the municipality from prison is a dangerous precedent and the situation creates problems both in terms of institutional functioning and in the perception of citizens.

According to him, this creates the impression that "not even judicial measures prevent the continuation of the exercise of political and administrative power by politicians who are being investigated for criminal offenses."

At the same time, he adds, this situation risks deepening the institutional tension between representatives of justice and representatives of politics, raising questions about the separation and balance between these two powers.

For Haxhimali, the legal act signed by Veliaj can be reversed within 7 days by the Prefect of Tirana, who has the right to object to its legal basis.

According to him, this order can also be appealed in court by Ristani himself.
