Kosovo constitutes the Assembly, but the President remains in question

Acting President Albulena Haxhiu has mandated Albin Kurti to form the new Government, after the Vetëvendosje Movement officially proposed its leader and acting Prime Minister for this position.

The next step is for Kurti to present the composition and program of the Government to the Kosovo Assembly, where he will request a vote on the new cabinet.

The LVV has said in the past that it has 62 votes, one more than it needs to form a new government. Of these, 53 are LVV MPs, while nine are from non-majority communities.

Earlier in the day, despite the non-participation of the Democratic Party of Kosovo in the session and the withdrawal of Vlora Çitaku's candidacy for the position of deputy speaker, the process of constituting the Assembly was concluded with the election of all other deputy speakers.

The chairwoman of the session, Albulena Haxhiu, said that the Assembly "cannot remain hostage to anyone, to any political entity" and the process continued with the proposal of the Democratic League of Kosovo.

The LDK candidate for vice president, Kujtim Shala, was elected with 75 votes in favor.

Meanwhile, after eight failed candidacies from the Serbian List, the Assembly managed to elect the Serbian MP, Tanja Vujović, who also received votes from the Vetëvendosje Movement and some from the LDK.

From the non-Serb minorities, Bosniak MP Emilija Rexhepi was elected.

"I consider that the Assembly of the Republic of Kosovo is considered constituted," said Haxhiu, before closing the session.

In a previous decision, the Constitutional Court had left open the possibility that the Assembly, under certain circumstances, could function without one of the members of the Presidency, if his election is impossible and the Presidency has a quorum for decision-making.

One such circumstance was mentioned when a member of parliament or parliamentary group who has the right to propose a member of the presidency does not exercise this right or obstructs the process.

But PDK MP Përparim Gruda insisted that the Assembly cannot be declared currently constituted, arguing that the Constitutional Court's decision cannot be used in this case since PDK has not waived its right to propose it, while VV, according to him, cannot benefit from the violation of constitutional deadlines.

Acting Prime Minister and LVV leader, Albin Kurti, said that whenever PDK is ready to propose a candidate for the position of deputy leader, LVV MPs will vote for him.

Ndërkohë, PDK-ja kishte njoftuar paraprakisht se nuk do të marrë pjesë në seancat e Kuvendit deri në një vendim të Gjykatës Kushtetuese për situatën e krijuar rreth konstituimit të legjislaturës. Ajo tha se ekspertët e partisë janë duke përgatitur lëndën që do t’i drejtohet kësaj gjykate për procesin e konstituimit.

Vendimi erdhi pasi Lëvizja Vetëvendosje ndryshoi qëndrimin dhe tha se do t’i mbështesë kandidatët e PDK-së dhe Lidhjes Demokratike të Kosovës për nënkryetarë të Kuvendit.

Deputetët e Lidhjes Demokratike të Kosovës ishin të vetmit nga ish-opozita që morën pjesë në këtë seancë, pasi që Aleanca qysh më herët kishte vendosur të mos merrte pjesë.

Pas seancës, deputetja e LDK-së, Jehona Lushaku-Sadriu, tha se partia e tij do ta mbështesë cilëndo iniciativë ligjore për të sqaruar dilemat për afatet kushtetuese për konsituimin e Kuvendit dhe shtoi se do të kontribuojnë me komentet e tyre në kërkesën e PDK-së për Gjykatën Kushtetuese.

Ndërkohë, teksa hynin në Kuvend para seancës së sotshme, deputetë të LVV-së insistuan se qëndrimin e kanë ndryshuar vetëm që të zhbllokohet procesi i konstituimit, që të shmangen zgjedhje të katërta parlamentare brenda dy vjetëve.

Por, kryetari i Aleancës, Ardian Gjini, dhe një deputet i LDK-së, Ermal Sadiku, e kanë interpretuar këtë vendim si pjesë të një skenari që, sipas tyre, çon drejt zgjedhjeve të reja më 27 dhjetor.

Tani që Kuvendi është konsituuar, afati 60-ditor për zgjedhjen e presidentit ka filluar. Nëse deputetët nuk do të arrijnë ta zgjedhin një president të ri, atëherë duhet të shpallen zgjedhjet brenda 45 ditëve.

“60 ditë plus 45 ditë na çojnë pikërisht te 27 dhjetori. Pra, krejt ky bllokim, krejt këto lojëra me Kuvendin, krejt kjo zvarritje veç për të mbërritur te data që e kanë planifikuar”, ka shkruar Sadiku.

Megjithatë, nuk dihet nëse Gjykata Kushtetuese mund ta shpall procesin si të pavlefshëm si përgjigje ndaj kërkesës që pritet të parashtrohet nga PDK-ja.

Zgjedhjet më 27 dhjetor do të binin në periudhën e festave të fundvitit, kur një pjesë e madhe e diasporës së Kosovës kthehet në vend.

Kjo e bën datën politikisht të rëndësishme, veçanërisht për LVV-në, e cila në zgjedhjet e fundit ka marrë një përqindje më të lartë të mbështetjes nga votuesit jashtë Kosovës sesa në mesin e votuesve rezidentë.

Në zgjedhjet e qershorit 2026, LVV-ja kishte fituar rreth 73 për qind të votave me postë, 83 për qind të votave në përfaqësi diplomatike. Ndërsa, nga votat e qytetarëve rezident kishte marrë rreth 43 për qind.

Këto zhvillime i hapin rrugë fundit të një bllokade politike që nisi pas zgjedhjeve të parakohshme parlamentare të mbajtura më 7 qershor.

The LVV came first, winning 53 seats. It says it has the support of nine minority MPs - eight from non-Serb minorities, excluding Adem Hoxha from the Gorani United Party and Duda Bale from the Social Democratic Union, and Nenad Rašić, as the only minority Serb MP who is not part of the Serbian List.

This means she has 62 votes, one more than she needs to form a government. However, these votes are not enough to elect the country's new president.

To elect the president in the first two rounds, 80 votes are needed, which also requires the support of MPs from other parties.

For weeks, the main clash was over the constitution of the Assembly, as the LVV insisted that the Assembly should not be constituted before an agreement was reached on the post of president.

On August 31, negotiations between the LVV and the LDK ended with the official announcement that the two parties would support Bekim Sejdiu's joint candidacy for president.
