The Federal Supreme Court of Brazil has rejected Ervin Mata's second appeal against his extradition to Albania. According to the Court's decision, the decision was made on October 20, 2026, unanimously by the first panel of the court, with Minister Alexandre de Moraes as rapporteur.
Ervin Mata's lawyers claimed that the previous decision had left several issues raised by the defense unaddressed. The defense requested a stay of the extradition proceedings, arguing that Ervin Mata's application for refugee status in Brazil was still pending.
The lawyers also raised the fact that a formal police investigation had been opened against Mata in Brazil. The third claim related to jurisdiction, arguing that Albania, as the country that had requested extradition, did not have jurisdictional competence to conduct criminal proceedings against him. For these reasons, the defense requested the acceptance of the declaratory appeal.
According to rapporteur Alexandre de Moraes, the appeal did not present sufficient arguments to identify shortcomings in the previous decision. The court assessed that the decision was fully reasoned, while the appeal was protracted and delayed the completion of the extradition procedure.
For this reason, the appeal was not accepted for review and the court ordered the certification of the decision as final, without waiting for its publication.
The Federal Supreme Court of Brazil had approved Albania's request for the extradition of Ervin Mata on August 21, 2026. The decision was taken unanimously, after reviewing the case in the virtual session held from August 14 to 21.
