Who is competent to react if documentation is destroyed in Serbian institutions in Kosovo and who can prevent the possible removal of evidence of abuse?
This issue arose after a group of students from the University of North Mitrovica, who support the students protesting in Serbia, expressed suspicions that official documents are being destroyed in some Serbian institutions in Kosovo.
The Serbian judicial system has had no jurisdiction in Kosovo since 2017, when, based on an agreement within the framework of the dialogue mediated by the European Union, it was integrated into the Kosovo system.
In recent days, information has been circulating in Serbia that documentation is being destroyed in Serbian state institutions. For this reason, the Chief Public Prosecutor of Serbia, Zagorka Dollovac, on October 29 instructed all high prosecutors' offices to urgently contact the police with requests to take measures to prevent the destruction of official documents and other files.
As stated in the instruction, the information made public relates to the destruction of documents in state institutions, banks, the Security and Information Agency, the Military Intelligence Agency and other institutions important for the economic, financial and legal security of Serbia.
Radio Free Europe/Radio Liberty approached the office of the High Public Prosecutor in Serbia with the question of how it will verify the suspicions of the destruction of documentation in Serbian institutions in Kosovo and in those that have been relocated to Serbian border towns after being closed by Kosovo authorities.
As of the publication of this article, this institution has not responded.
Currently, in Kosovo, mainly educational and health institutions operate according to the Serbian system.
What kind of abuses are we talking about?
A group of students from the University of North Mitrovica, which operates according to the Serbian system, announced that they had received information that documentation was being destroyed at the Clinical Hospital Center in North Mitrovica, as well as in the provisional municipal bodies.
The Clinical Hospital Center operates under the Serbian system, as do the provisional municipal bodies. However, Kosovo authorities have closed them over the past two years, along with other institutions that were financed from the Serbian budget, on the grounds that they are parallel and illegal.
What documents can be destroyed?
Dušan Janjić believes that the leaders of Serbian institutions in Kosovo can destroy, first of all, those documents that in some way connect them to the former deputy leader of the Serbian List, Milan Radoićić.
Radoićić claimed responsibility for the attack in Banjska in September 2023, while Kosovo has issued an arrest warrant for him, as he is not accessible to the justice system.
He says that this is why the Special Prosecution Office in Kosovo must react, as this institution is conducting procedures regarding the Banjska case.
Serbia's institutions are mainly run by representatives of the Serbian List, the largest Serb party in Kosovo, which has so far acted with the support of the Serbian Progressive Party and former Serbian President Aleksandar Vučić.
This party said on Friday that it "accepts" the results of the parliamentary elections in Serbia, which the Student List won, and that it remains committed to institutional ties with Belgrade.
REL was unable to obtain a comment from the Student List by the time of publication of this article regarding suspicions that documentation is also being destroyed in institutions in Kosovo.
Representatives of this political movement, which was created from student protests against corruption in Serbia, on October 29 asked employees in various institutions to report cases of destruction of documentation during the transition period, until the formation of new institutions.
Rodoljub Šabić, a lawyer and former Commissioner for Public Information and Personal Data Protection in Serbia, stressed that in 2026 it is difficult to destroy official documentation that is stored in electronic form.
However, he stated that Serbia has been a non-transparent country for the last ten years, or more precisely, according to him, has had a non-transparent government, due to which it is not known how important official documents have been stored or packaged. /REL
