
SPAK has begun verifications following the complaint of justice workers regarding salaries. Referring to unofficial sources, it is said that after administering the complaint, which requires a series of investigative actions, the case has been registered and is being verified.
The complaint relates to the freezing of the salaries of judges and prosecutors for the month of August 2026. According to the circumstances described in the document, the Constitutional Court had decided on February 17, 2026 to repeal the 2023 amendments to the law on the status of judges and prosecutors, finding that they had brought about a “secret” reduction in the salaries of magistrates. The Court had given the Assembly until July 31, 2026 to adopt the necessary legal amendments, a deadline that the Assembly did not respect. Under these conditions, the High Judicial Council ordered the implementation of the basic reference salary according to the parameters of the Council of Ministers No. 325/2023, with effect from August 1, 2026. According to the complaint, Treasury branches in almost the entire country, with the exception of Kukës and Dibra, refused to implement the payment orders with the new formula, based on an electronic message forwarded by the Secretary General of the Ministry of Finance.
Minister Malaj, in a letter dated September 2 addressed to both councils, justified the blocking with the need for verifications on the legal basis of the payrolls and promised prompt payment after the approval of the amendments by the Assembly. The plaintiffs dispute this justification, arguing that neither the Ministry of Finance nor the Treasury have the legal authority to unilaterally block the execution of a court decision, even when there are administrative disagreements, and that the only legal recourse for the state would be to sue in court.
The report requests the performance of a series of investigative actions, including the management of documentation related to the decisions of the Constitutional Court, the Supreme Court of Justice and the Supreme Court of Justice, correspondence between the Ministry of Finance and Treasury branches, electronic traces of actions in the Treasury system, as well as verification of whether budgetary funds for August 2026 salaries were available.
