Analysis/ Can Haxhiu serve as president for another 6 months?

In less than a month, Kosovo could face a constitutional impasse if a new president is not elected by October 4. Legal experts say the speaker of parliament cannot continue in office beyond this six-month term.

The current incumbent, Albulena Haxhiu , was re-elected as Speaker of the Kosovo Assembly on September 9, while earlier her party, the ruling Vetëvendosje Movement, had floated the idea that the new Speaker of the Assembly could continue for a second six-month term if necessary.

Even the Presidency - which Haxhiu has led since April 4, when the then-president, Vjosa Osmani, ended her mandate - has said that the new Speaker of the Assembly would continue to exercise the duties of president until the election of a new president.

Can Haxhiu continue in office beyond October 4?

No, say several legal experts, whom Radio Free Europe spoke with.

The position of acting president of Kosovo cannot be held for a period longer than six months, according to the Constitution.

Vullnet Bugaqku from the Democratic Institute of Kosovo estimates that Haxhiu, as Speaker of the Assembly, her mandate as acting president ends on October 4.

"After this date, the six-month term expires and legally the same person does not have the right to function as acting president, because it is in contradiction with Article 90, paragraph 3, of the Constitution of Kosovo," Bugaqku told REL on Wednesday, after Haxhiu was re-elected as speaker of parliament.

According to Bugaqku, any decision or decree that may be issued after this date by Haxhiu is constitutionally questionable, and risks being overturned by the courts.

He says that MPs should view the deadline of October 4th for electing the president as alarming.

Haxhiu interrupted the constitutive session on Wednesday, postponing its continuation until Friday to conclude the constitution of the Assembly.

She said that there was no consensus on the method of voting for the vice-presidents and that the Serbian List MP, Igor Simić , failed to withdraw the word "on behalf of the Serbian people" when he proposed the candidate for vice-president from the Serbian community.

Meanwhile, the executive director of the Kosovo Law Institute, Ehat Miftaraj , tells REL that the Constitution of Kosovo links the six-month limitation to the exercise of the office of president, not to the person exercising it.

“Tejkalimi i 4 tetorit pa një president të ri cenon sigurinë e shtetit”

Bugaqku shton se, për shtetin dhe sistemin kushtetuese parlamentar në Kosovë, tejkalimi i afatit të 4 tetorit do të thotë “një njollë shumë e keqe dhe një precedent i rrezikshëm që cenon edhe sigurinë kombëtare”.

Më 4 tetor përfundon periudha gjashtëmujore gjatë së cilës, sipas Kushtetutës, postin e presidentit të Kosovës mund ta mbajë një ushtrues detyre.

Deputeti i LVV-së, Adnan Rrustemi, kishte thënë më herët për REL-in se pozita e ushtruesit të detyrës së presidentit “është e varur nga pozita e kryetarit të Kuvendit”.

Sipas tij, pas zgjedhjes, kryetari i ri i Kuvendit nis ushtrimin e detyrës së presidentit deri në zgjedhjen e presidentit. Afati prej gjashtë muajsh, i përcaktuar nga Kushtetuta, nis të rrjedhë nga fillimi, me zgjedhjen e kryetarit të ri të Kuvendit, pretendoi ai.

“Është në frymën dhe përmbajtjen, por edhe në funksionin e Kushtetutës, që të garantojë vazhdimësi institucionale. Asnjëherë, e për asnjë arsye, vendi nuk mund të mbetet pa president apo pa ushtrues detyre të presidentit. Vakum institucional nuk mund të ketë në asnjë rrethanë”, deklaroi Rrustemi për REL-in.

Më herët, Eugen Cakolli, hulumtues në Institutin Demokratik të Kosovës, i kishte thënë REL-it se periudha gjashtëmujore për ushtrimin e detyrës së presidentit përbën afat absolut, dhe si i tillë nuk mund të përsëritet në asnjë skenar.

Moszgjedhja e presidentit të ri, deri më 4 tetor, sipas Cakollit, përbën skenarin më të rrezikshëm kushtetues me të cilin mund të ballafaqohet Kosova.

“Në një situatë të tillë, vendi do të hynte në një terren kushtetues, i cili, përveçse do të ishte serioz dhe i rrezikshëm, do të duhej medoemos të kishte parashtresë në Gjykatën Kushtetuese”, theksoi ai.

Melos Kolshi, hulumtues ligjor në Institutin e Kosovës për Drejtësi, i tha REL-it se pas 4 tetorit, çdo vazhdim i ushtrimit të detyrës së presidentit do të ishte pa bazë kushtetuese, dhe do të cenonte seriozisht rendin kushtetues.

Partitë opozitare shqiptare nuk janë deklaruar për këtë çështje publikisht.

Partia Demokratike e Kosovës (PDK), Lidhja Demokratike e Kosovës (LDK) dhe Aleanca nuk iu përgjigjën as pyetjeve të REL-it rreth kësaj çështjeje.

Çështja e zgjedhjes së presidentit ka qenë në zemër të krizës politike në vend dhe shkaktoi zgjedhje të reja parlamentare në qershor.

A fragile agreement between LVV and LDK for the candidacy of Kosovar diplomat and lawyer, Bekim Sejdiu , does not seem to have the necessary support, as even MPs from LDK itself have publicly opposed it.

The presence of 80 deputies in the 120-seat Assembly is required for the vote for the president of Kosovo to be valid.
