The State Cadastral Agency has reacted for the first time regarding the property conflict that led to the gunfight between two businessmen in Radhimë. In response to the "Top Story" show, ASHK says, among other things, that this property was reported to SPAK by the Cadastre in 2025, under suspicion of forgery.
"For this title deed, within the framework of the administrative verifications carried out and for issues requiring assessment by the competent authorities, ASHK forwarded the relevant documentation to the Special Anti-Corruption Structure in 2025, given that there were reasonable suspicions of a possible forgery," the Cadastre's response states, among other things.

According to ASHK, it is stated that the Entity "Delta" sh.a., of Muça, in 2019, and further 2020, 2021, has filed legal documentation for several property titles acquired through sale and purchase contracts, the origin of which is related to decisions of former property restitution commissions, court decisions and AMTP.
Also, the permit obtained by the entity in question for the resort "Delta Falaise resort & village, zone 1" was registered in the special register of construction permits on 24.07.2024, and this is the only permit registered to date regarding the matter of your interest.
Regarding the other entity involved in the property claims conflict with the entity "Delta" sh.a., from the verification of data administered by ASHK, it results that for the area in question, no request has been submitted and no service has been issued for equipment with a certificate of ownership in the name of this entity.
But it turns out that a request was filed there and a certificate of ownership was issued in July 2024 in the name of another individual, for a property title, the origin of which derives from a decision of the former Property Restitution and Compensation Commission.

"In response to your request, submitted in support of Law No. 119/2014 "On the Right to Information", the State Cadastre Agency clarifies the following:
Referuar përcaktimit të bërë në kërkesën tuaj për zonën “mes Drimadhës dhe Palasës”, sqarojmë se kjo hapësirë i përket Zonës Kadastrale nr. 1739, për të cilën procesi i regjistrimit fillestar, në Marrëveshje midis ASHK dhe Bashkisë Himarë, pritet të përfundojë brenda vitit 2027.
Në lidhje me dokumentacionin që lëshohet nga ASHK në rast interesimi për zhvillim të pronës, sqarojmë se, në zonat kadastrale ku nuk ka përfunduar ende regjistrimi fillestar, vërtetimi i pronësisë/vërtetimi hipotekor është prova se subjekti ka depozituar pranë ASHK-së dokumentet ligjore që disponon për titullin e pronësisë,.
Në kuptim të nenit 19, të Ligjit 111/2018 “Për Kadastrën”, pikës 24 të VKM nr. 782/2020, të ndryshuar, këto vërtetime janë të vlefshme për përdorim nga pronari dhe autoritetet publike deri në përfundimin e procesit të regjistrimit fillestar.
Sqarojmë po ashtu se regjistrimi fillestar është procesi nëpërmjet të cilit shqyrtohen dhe evidentohen titujt e pronësisë dhe, për titujt që plotësojnë kushtet ligjore për regjistrim, të dhënat përkatëse pasqyrohen në kartelën e pasurisë dhe në hartën kadastrale të zonës.
Nga të dhënat e administruara rezulton se:
Subjekti “Delta” sh.a. në vitin 2019, e më tej 2020, 2021 ka depozituar dokmentacion ligjor për disa tituj pronësie të fituar nëpërmjet kontratave të shitblerjes, origjina e të cilëve lidhet me vendime të ish-komisioneve të kthimit të pronave, me vendime gjykate dhe me AMTP. Gjithashtu, është regjistruar në regjistrin e vecante të lejeve të ndërtimit në datë 24.07.2024 leja e fituar nga subjekti në fjalë, për resortin “Delta Falaise resort & village, zona 1”, dhe kjo është e vetmja leje e regjistruar deri më sot lidhur me çështjen e interesit tuaj.
Sa i përket subjektit tjetër të përfshirë në konfliktin e pretendimeve pronësore me subjektin “Delta” sh.a., nga verifikimi i të dhënave të administruara nga ASHK rezulton se për zonën në fjale, nuk është paraqitur kërkesë dhe nuk është lëshuar shërbim për pajisje me vërtetim pronësie në emër të këtij subjekti. Por rezulton ndërkohë, se po aty është paraqitur kërkesë dhe është lëshuar në korrik 2024 vërtetim pronësie në emër të një individi tjetër, për një titull pronësie, origjina e të cilit rrjedh nga një vendim i ish-Komisionit të Kthimit dhe Kompensimit të Pronave. Për këtë titull pronësie, në kuadër të verifikimeve administrative të kryera dhe për çështje që kërkojnë vlerësim nga organet kompetente, ASHK ka përcjellë në vitin 2025 pranë Strukturës së Posaçme Antikorrupsion, dokumentacionin përkatës duke qenë se ka pasur dyshime të arsyeshme për një falsifikim të mundshëm.
"With regard to the request for making available copies of original ownership documents or archival documentation of private entities, ASHK is obliged to respect the provisions of Law No. 124/2024 "On the Protection of Personal Data", as well as the provisions of Law No. 111/2018 "On the Cadastre", which prohibit individual documentation on a property from being made available to anyone other than the owners/holders of property rights or persons who prove that they have a legitimate interest in the relevant property," states the response to ASHK's Top Story.
