The Special Court will announce its verdict in the case against four former leaders of the Kosovo Liberation Army: Hashim Thaçi, Kadri Veseli, Jakup Krasniqi and Rexhep Selim on September 16 in The Hague.
The court, officially known as the Kosovo Specialist Chambers and Prosecutor’s Office, has been trying the four defendants for three years on charges of war crimes and crimes against humanity allegedly committed during and immediately after the war in Kosovo. The prosecution had sought sentences of 45 years in prison for each of the four defendants.
The outcome of this trial remains unknown. Meanwhile, another trial is being conducted in parallel before the same court against former Kosovo President Hashim Thaçi, on charges of obstruction of justice.
This raises the question, if Thaçi were found not guilty in the case of war crimes and crimes against humanity, would he be immediately released from detention?
According to the Rules of Procedure and Evidence of the Special Court, “when an accused person in pre-trial detention is declared innocent, he shall be released immediately, unless he is lawfully detained or is serving a sentence for criminal offenses other than those for which he was declared innocent.”
"In the case of Mr. Thaçi, detention has been ordered by the Trial Chamber in his trial for war crimes and crimes against humanity, as well as by the single judge in the separate trial for obstruction of justice. Therefore, if Mr. Thaçi is found not guilty in the trial for war crimes and crimes against humanity, the question of whether he will continue to be held in detention will be decided by the single judge hearing the obstruction of justice case," Specialist Chambers spokesman Michael Doyle said in a response to Radio Free Europe.
The single judge must review every two months whether the detention continues to be reasonable and justified.
"He may also review this matter at the request of the accused, if there has been a change in circumstances," Doyle added.
The last decision, the tenth in a row, to extend pre-trial detention was issued by the single judge on July 31, assessing that there is still a risk that Thaçi will obstruct proceedings or commit other criminal offenses.
In the same decision, the judge also set deadlines for the next detention review: Thaçi can submit his submissions by September 7. If he does not do so, the Prosecution must submit its position by September 14, while Thaçi can respond by September 21.
What are the two cases against Thaçi?
Thaçi ndodhet në qendrën e paraburgimit në Hagë që nga nëntori i vitit 2020, kur u arrestua nën akuza për krime lufte. Që atëherë, mbrojtjes së Thaçit i janë refuzuar të gjitha parashtresat për lirim nga paraburgimi. Madje, është refuzuar edhe një dorëzani prej 50 mijë eurosh, së bashku me disa kushte që Thaçi u zotua t’u përmbahej, në këmbim të lirimit nga paraburgimi.
Ish-presidenti Thaçi, së bashku me ish-kryeparlamentarët Jakup Krasniqi dhe Kadri Veseli, si dhe ish-deputetin Rexhep Selimi, janë deklaruar të pafajshëm për akuzat për krime lufte dhe krime kundër njerëzimit.
Sipas aktakuzës, Thaçi dhe të tjerët akuzohen se ishin pjesë e një “ndërmarrjeje të përbashkët kriminale” që synonte kontrollin përmes frikësimit dhe dhunës ndaj kundërshtarëve. Viktimat përfshinin serbë, romë dhe shqiptarë që nuk mbështesnin UÇK-në; së paku 102 persona dyshohet se u vranë dhe mbi 20 mbeten të zhdukur. Prokuroria i konsideron ata përgjegjës edhe për krimet e vartësve të tyre.
Thaçi, i cili më herët ka qenë edhe kryeministër i Kosovës, i ka cilësuar ato si “krejtësisht të pavërteta, absurde dhe thellësisht fyese”.
Në mbështetje të mbrojtjes kanë dëshmuar disa prej figurave më të njohura të diplomacisë dhe sigurisë perëndimore të kohës së luftës, përfshirë ish-zëdhënësin e Departamentit amerikan të Shtetit, James Rubin, dhe ish-komandantin e NATO-s për Evropën, Wesley Clark.
Ata kanë deklaruar se UÇK-ja nuk funksiononte si një strukturë e centralizuar dhe se të akuzuarit kishin më pak ndikim dhe kontroll sesa pretendohet në aktakuzë.
Gjykimi ndaj tyre për këtë rast përfundoi në shkurt të këtij viti dhe që të katërt gjenden në paraburgim prej gati gjashtë vjetësh.
Teksa po mbahej ky proces gjyqësor, Zyra e Prokurorit të Specializuar në Hagë më 2024 ngriti akuza për pengim të drejtësisë ndaj Thaçit dhe katër personave të tjerë: ish-ministrit të Drejtësisë, Hajredin Kuçi; ish-shefit të Agjencisë së Kosovës për Inteligjencë, Bashkim Smakaj; ish-kryetarit të Malishevës, Isni Kilaj; dhe Fadil Fazliut.
Ata akuzohen se, mes prillit dhe nëntorit 2023, kishin ndikuar te dëshmitë e dëshmitarëve të thirrur nga prokurorët për çështjen gjyqësore për krime lufte kundër vetë Thaçit dhe tre ish-krerëve të UÇK-së.
Thaçi ngarkohet me tri akuza për tentativë për pengim të personave zyrtarë në kryerjen e detyrave zyrtare, me anë të pjesëmarrjes në veprimin e përbashkët të një grupi; katër akuza për shkelje të fshehtësisë së procedurës, dhe katër akuza për mosbindje ndaj gjykatës.
Përveç Thaçit, të gjithë të akuzuarit e tjerë në rastin për pengim të drejtësisë po mbrohen në liri.
Ky rast po shkon drejt fundit, pasi deklaratat përmbyllëse janë caktuar që të mbahen më 10, 11 dhe 14 shtator.
