A draft report by the Council of Europe on local governance in Albania assesses that public services are centralized, municipalities have limited autonomy, and suggests that the new territorial reform should focus on increasing local capacities, not further centralization.

The Council of Europe suggests that a new territorial reform in Albania should focus on further decentralization of local government in competencies and functions as well as higher and equal financial support for units – suggestions that contradict the government's plans for further centralization of this power by proposing fewer municipalities.

A preliminary monitoring report on the implementation of the European Charter of Local Self-Government in Albania, prepared by rapporteurs Anders Knape and Sören Schumacher, suggests that any change to the administrative map should be based on real consultation with local governments and local communities, after carefully evaluating the 2014 reform. A decade after this reform, the socialist majority released an analytical study that concluded that the current map no longer responds to the country's demographic and economic reality, proposing a territorial reorganization as a mechanism to increase efficiency.

Unlike the SP analysis, the Council of Europe draft report shifts the analysis to the causes that have produced this poor performance, not limiting itself to the size or capacity of municipalities, but to the centralization of competences, limited autonomy, insufficient funding and lack of administrative resources. The CoE rapporteurs raise concerns that this will not solve the problems, suggesting that the performance of local government requires further decentralization, increased competences and financial resources of municipalities.

“The proposed new structural reform, which is expected to bring about further mergers of local self-government units, divides public opinion and local representatives mainly along political lines,” the document notes.

The rapporteurs point out that “there is a discrepancy between the further merger of municipalities and the continued centralization of some public services”.

Based on the monitoring findings, they assess that local government in Albania should be entrusted with a significantly greater role in the provision of local public services.

“Ndërsa qeveria argumenton se bashkive u mungojnë kapacitetet për të administruar në mënyrë të pavarur fusha si arsimi, furnizimi me ujë dhe menaxhimi i mbetjeve, raportuesit theksojnë se, në frymën e Kartës Evropiane të Vetëqeverisjes Vendore, përgjigjja e duhur nuk është centralizimi, por forcimi i kapaciteteve administrative dhe financiare të pushtetit vendor,” thotë raporti.

Në këtë kontekst, ata vërejnë se për shumë funksione të detyrueshme bashkitë nuk gëzojnë kompetenca të plota dhe ekskluzive, por kufizohen në zbatim mekanik të vendimeve ose mirëmbajtje institucionale. Si rrjedhojë, raporti konstaton se “Shqipëria nuk përfiton plotësisht nga parimi i subsidiaritetit”.

Mospërmbushja e detyrimeve ligjore nga njësitë vendore lidhet kryesisht me varësinë nga financat qendrore. Vëzhgimi i raportuesve del në përfundimin se me përjashtim të qyteteve më të mëdha, pushteti vendor në Shqipëri është seriozisht i nënfinancuar dhe nuk disponon burime të mjaftueshme për të përmbushur detyrimet ligjore.

“Për këtë arsye, është e nevojshme të rishikohet mënyra e llogaritjes së granteve të pakushtëzuara, pasi niveli aktual i tyre është i ulët dhe mban bashkitë në vështirësi financiare”- rekomandon ai duke konstatuar se shumica e bashkive nuk janë në gjendje të zhvillojnë politika të tyre vendore. Në këtë kuadër, raportuesit e Këshillit të Europës japin rekomandime për decentralizim të pushtetit vendor, forcim të kapaciteteve të tyre financiare dhe delegim të shërbimeve.

Mënyra se si qeveria qendrore financon njësitë vendore konsiderohet si jo efektiv dhe ka shqetësime për pabarazi në ndarjet e këtyre financave për arsye politike.

“Sistemi aktual i barazimit financiar, i zbatuar përmes granteve të pakushtëzuara, nuk duket efektiv në përmirësimin e gjendjes së bashkive financiarisht më të dobëta ose në zvogëlimin e pabarazive rajonale. Raportuesit rekomandojnë një rishikim të plotë të këtij sistemi dhe krijimin e një mekanizmi më efektiv e transparent, të bazuar në kritere objektive”.

“Ashtu si në luftën kundër korrupsionit, transparenca është thelbësore edhe në shpërndarjen e burimeve buxhetore,” shton më tej raporti, duke e lidhur këtë me nevojën për trajtim të barabartë të njësive të vetëqeverisjes vendore dhe shpërndarje të subvencioneve sipas kritereve objektive dhe të verifikueshme. Një tjetër shqetësim lidhet me faktin autonomia e bashkive në zbatimin e funksioneve të deleguara, siç janë arsimi apo menaxhimi i mbetejeve, mbetet shumë e kufizuar.

In this regard, the rapporteurs conclude that many municipalities do not have sufficient financial resources and personnel to carry out the delegated functions and are forced to cover these costs from their budgets, which is contrary to one of the fundamental principles of the Charter, according to which local authorities should be financed by the state in accordance with the responsibilities assigned to them by law. Particular attention is paid to the problem of collecting local taxes, a competence that Albanian municipalities do not exercise effectively due to administrative shortcomings.

The report highlights the property tax, which is hampered by the lack of accurate property registries. Expanding local competences and increasing financial resources is an essential element in the country's commitment to European Union membership, the report further notes, as "the effective absorption and management of future EU funds depend on the existence of a strong and functional local government system."

'Corruption' and 'political polarization' are also considered as challenges for local government. Local self-government units are expected to play an important role in the fight against corruption. Cases of corruption undermine public trust in local authorities and negatively affect their autonomy, as they are often used as an argument in favor of greater centralization.

The depopulation of rural municipalities, especially due to the migration of young people to large cities or abroad, is considered a phenomenon with 'serious consequences for local communities'. The document, which assesses whether the Albanian system of local government respects the standards of the Charter and where the new reform undertaken by the Albanian parliament should focus, is expected to be reviewed at the Congress of Local Authorities of the Council of Europe in October./BIRN
