
The suspension of the session for the constitution of the Kosovo Assembly escalated clashes between MPs on Wednesday, while political parties seek solutions to the institutional blockade and the election of the president.
The leader of Vetëvendosje, who is also the acting prime minister, Albin Kurti, requested additional time until a political agreement is reached, especially on the issue of the president, which would unblock the political impasse that has now lasted almost two years.
But the opposition political parties, who do not want an agreement with Vetëvendosje, the Democratic Party of Kosovo PDK and the Alliance, demanded that the chairman of the constitutive session, Avni Dehari, who comes from Vetëvendosje, call for the session to continue, despite the fact that the constitutional deadline of 30 days for the constitution of the Assembly has already passed.
Verbal and physical altercation without injury
Verbal clashes and physical pushes occurred between PDK and Vetëvendosje deputies, but no one was injured.
According to the deputy leader of the Democratic Party of Kosovo, Vlora Çitaku, the activity of the second party after Vetëvendosje "will no longer be limited only within the institution of parliament, but will also move outside the Assembly into broader forms of political, democratic and civic mobilization."
"We call on Albin Kurti to return the country to constitutional tracks, to constitute the Assembly, to allow the deputies to exercise their mandates. We are not seeking power, we are not seeking an agreement for the PDK. We are seeking the functioning of the state," said Çitaku.
The head of the Alliance's parliamentary group, Besnik Tahiri, also said that "the blocking of the Kosovo Assembly is a violation of sovereignty and constitutional order, adding that the Alliance "will not allow the right of citizens to have institutions to be violated in any way."
Deadline for constitution
According to the Constitutional Court's decision, the Kosovo Assembly had to be constituted no later than August 7, 30 days after the certification of the results of the June 7 elections.
The constitutive session began on August 6, but even after the request of the acting Prime Minister Albin Kurti for additional time until a political agreement is reached, the Assembly failed to elect the speaker and deputy speakers. The Democratic League of Kosovo, which is in talks with Vetevendosje for a possible co-government, has not yet agreed on a political agreement, while the other two parties, PDK and the Alliance, which do not want an agreement with Vetevendosje, say that the passing of the constitutional deadline for the constitution of the Assembly does not remove the obligation to continue and conclude the constitutive session.

Për çështjen e afatit kushtetues të konstituimit të Kuvendit, 14 organizata të shoqërisë civile iu drejtuan me kërkesë për interpretim Gjykatës Kushtetuese. "Kërkojnë nga Gjykata të vlerësojë nëse aktgjykimi i saj është zbatuar në përputhje me përcaktimet dhe afatet e tij, pas dështimit të Kuvendit që të përfundojë procesin e konstituimit brenda afatit kushtetues”, thuhet në kërkesë. Edhe një grup prej 46 intelektualësh dhe akademikësh, përmes një letre të hapur bëjnë apel për formimin e institucioneve të reja dhe mbrojtjen e rendit kushtetues, duke thënë se "ngërçi politik ngre rrezikun të cenojë rendin kushtetues, demokracinë dhe funksionimin e shtetit të së drejtës”.
"Kosova nuk mund të vazhdojë të mbetet pa institucione funksionale për shkak të kalkulimeve partiake, interpretimeve të njëanshme të Kushtetutës apo mungesës së vullnetit për kompromis demokratik”, thuhet ndër të tjera në letër.
"Gjykata Kushtetuese i ka qartësuar detyrimet e deputetëve lidhur me konstituimin e Kuvendit dhe ka thënë qartë që askush nuk ka të drejtë të pengojë ose bllokojë konstituimin e Kuvendit. Nuk duhet lejuar që vendi të mbetet në një gjendje të paralizës institucionale, e cila krijon precedentë të dëmshëm dhe pasoja afatgjata për funksionimin e institucioneve, rendin kushtetues, stabilitetin dhe sigurinë e vendit”, thuhet më tej në letër.
Reagimi i BE-së
Edhe prania ndërkombëtare në Kosovë u ka bërë udhëheqësve politikë që t'i japin përparësi progresit dhe stabilitetit, në të mirë të të gjithë qytetarëve. Bashkimi Evropian, përmes zyrës në Prishtinë, u ka bërë thirrje partive "që të arrijnë sa më shpejt marrëveshje për një kandidat të përbashkët për president”, duke paralajmëruar se "vonesat në formimin e institucioneve mund t'i pengojnë reformat dhe të ndikojnë në përfitimin e fondeve të BE-së”.
Sidoqoftë, një marrëveshje politike ndërmjet partisë fituese të zgjedhjeve, Vetëvendosjes, dhe partive opozitare është e domosdoshme në mënyrë që të shmangen edhe një palë zgjedhje të reja, që do të ishin të katërtat brenda dy vjetëve të fundit.
Kriza për zgjedhjen e presidentit mund të përsëritet
Partia në pushtet e kryeministrit në detyrë, Albin Kurti, Lëvizja Vetëvendosje, ka 53 mandate dhe, së bashku me pakicat joserbe që kanë 10 ulëse, mund ta zgjedhë kryetarin e Kuvendit dhe ta formojë qeverinë, sepse u duhen vetëm minimumi i nevojshëm prej 61 votash nga 120 vende sa i ka parlamenti.
Për zgjedhjen e presidentit apo presidentes kërkohet prania e të paktën 80 deputetëve në sallë, në mënyrë që votimi të jetë i vlefshëm, prandaj kriza për zgjedhjen e presidentit mund të përsëritet.
This is the second time this year, and the third in less than two years, that Kosovo has tried to form stable institutions after successive parliamentary elections. The June 8 snap elections were held because the Assembly was dissolved after failing to elect the country's new president. A similar election cycle could be repeated if, within the next 60 days after the constitution of the Assembly, there is no political agreement on the election of the president. If an agreement can be reached between Vetëvendosje and the Democratic League of Kosovo (LDK), which has 18 seats, then at least 81 votes would be reached, sufficient to vote for the new president, if at least 80 of them were to remain in the hall./DW
